The EAPES Legal Centre provides access to the current terms, privacy notices, policies, licences, product-specific rules, third-party disclosures, and historical archives associated with EAPES.COM, APP.EAPES.COM, EAPES Island, EAPES Validator, and related EAPES Services.

Each legal document should display:

  • its title;
  • version number;
  • effective date;
  • last-updated date;
  • language;
  • status; and
  • applicable entity or Service.

The Legal Centre distinguishes current documents from superseded or archived materials.

2. Document Status Labels

2.1 Current

The document currently applies to the relevant Service, subject to its stated effective date and scope.

2.2 Upcoming

The document has been approved for a future effective date but is not yet in force.

2.3 Product-Specific

The document applies only to an identified product, Service, collection, transaction, or program.

2.4 Superseded

The document has been replaced by a newer version and does not govern new use after the replacement date, except where its terms continue to apply to an earlier transaction or right.

2.5 Archived

The document or feature is preserved for historical consultation, transparency, record-keeping, or legacy asset recovery and is not an active Service.

2.6 Final Draft

The document has been prepared for publication review and becomes effective only when formally approved and published.

3.1 EAPES Terms of Use

The EAPES Terms of Use govern access to and use of EAPES-operated websites, applications, wallet interfaces, community features, digital experiences, and related Services.

3.2 EAPES Privacy Policy

The EAPES Privacy Policy explains how personal information is collected, used, disclosed, retained, and protected.

4. Product-Specific and Operational Documents

4.1 Digital Assets and Sales Policy

This Policy describes terms applicable to eligible purchases, NFTs, digital assets, virtual plots, transaction summaries, payment, delivery, fees, blockchain risks, product restrictions, cancellation rights, refunds, and error resolution.

The legal seller or service provider must be identified before an eligible transaction is completed.

Status: Planned — Not yet published as a separate policy.

4.2 EAPES Validator Terms

These terms apply to eligible EGLD delegation through EAPES Validator.

EAPES Validator is separate from the discontinued EAPES NFT staking programs and former EAPES-operated $EAPES Pools.

The Validator Terms should identify:

  • the validator operator;
  • applicable fees;
  • protocol dependencies;
  • delegation and withdrawal mechanics;
  • reward variability;
  • network and validator risks;
  • data processing; and
  • support contact information.

Status: Planned — Not yet published as a separate document.

4.3 Virtual Plot and EAPES Island Product Terms

These terms apply to a specific EAPES Island virtual plot or digital access product.

They should identify:

  • the seller;
  • the applicable NFT or digital asset;
  • current functionality;
  • developing functionality;
  • licence and access rights;
  • technical requirements;
  • transferability;
  • fees;
  • risks;
  • refund or cancellation rights; and
  • what the purchaser does not acquire.

A virtual plot is not physical land, a land title, an interest in real estate, a right to agricultural income, a right to yield, or ownership of EAPES.

Status: Product-Specific — Published only with the applicable product or program.

4.4 Banana Cultivators Program Rules

These rules describe current gameplay or participation mechanics involving virtual cultivation, Bananas, Banana Points, Boosts, virtual trees, or eligible virtual plots.

The rules must not present the program as financial yield, passive income, an investment return, or a conversion service into $EAPES.

Status: Product-Specific — Published only when an applicable Banana Cultivators program is active.

5. Intellectual Property and Licensing

5.1 Intellectual Property Owner

Unless expressly identified otherwise, all right, title, and interest in EAPES-owned intellectual property are held by:

EAPES L.L.C., a Wyoming limited liability company. Mailing and principal office: 30 N Gould St Ste R, Sheridan, WY 82801, United States. Registered agent: Northwest Registered Agent LLC, 30 N Gould St Ste N, Sheridan, WY 82801, United States.

EAPES intellectual property may include:

  • the EAPES name and brand;
  • logos and trademarks;
  • characters and artwork;
  • collections;
  • visual identities and designs;
  • 3D assets and animations;
  • EAPES Island content;
  • website and dApp content;
  • software and interfaces;
  • documentation; and
  • related creative assets.

Ownership of an EAPES NFT, Island Relic, $EAPES, Banana, Banana Point, Virtual Plot NFT, or other digital asset does not transfer ownership of EAPES intellectual property.

5.2 Intellectual Property and Brand Licence Policy

This Policy explains:

  • personal display rights;
  • collection-specific licences;
  • permitted and prohibited uses;
  • commercial licensing;
  • Made by EAPES;
  • MBA EAPES;
  • creator or partner permissions;
  • use of names, logos, characters, and artwork;
  • licence duration and termination; and
  • the effect of transferring an NFT.

Specific rights arise only from the applicable written licence or agreement.

This page explains how to report suspected copyright, trademark, or other intellectual-property infringement involving an EAPES-operated Service.

It should identify:

  • the correct EAPES entity;
  • the designated contact;
  • required notice information;
  • counter-notice procedures where applicable; and
  • consequences of knowingly false claims.

5.4 Existing Written Licences

An existing Made by EAPES, MBA EAPES, creator, commercial, promotional, partnership, or other written licence remains governed by its own terms.

Publication of a new general policy does not retroactively revoke a separate licence that remains legally valid.

6. Identity, Eligibility, and Restricted Access

6.1 Identity Verification and Eligibility Policy

This Policy applies only where a specific product, transaction, jurisdiction, provider, or documented risk control requires identity or eligibility verification.

Before collecting verification information, EAPES should identify:

  • the information required;
  • the purpose;
  • whether submission is mandatory;
  • the verification provider;
  • retention;
  • processing locations;
  • data recipients; and
  • the consequences of refusing.

No universal monetary verification threshold should be stated unless it has been legally and operationally confirmed for the applicable activity.

6.2 Sanctions and Restricted Access Notice

This Notice explains that access may be restricted based on sanctions, location, residence, legal requirements, eligibility, fraud controls, or technical limitations.

EAPES may refuse to construct or facilitate a transaction before it is submitted to a blockchain. EAPES cannot normally reverse a completed blockchain transaction.

Status: Current — Access may be restricted under applicable law and operational controls.

7. Accessibility

7.1 Accessibility Policy

This Policy describes EAPES’s accessibility commitments, available support, known limitations, and methods for reporting an accessibility barrier.

Status: Planned — Separate Accessibility Policy to be published.

8. Third-Party Services

Some EAPES pages link to independent third-party services.

A link does not mean that EAPES operates, controls, guarantees, or assumes responsibility for the third-party service.

8.1 OneDex

Third-Party Service — Not Operated by EAPES

OneDex is an independent third-party service.

EAPES does not operate or control:

  • OneDex smart contracts;
  • $EAPES staking made available through OneDex;
  • OneDex liquidity pools;
  • reward calculations;
  • fees;
  • security;
  • availability;
  • eligibility requirements; or
  • terms.

Users should review OneDex’s own information, terms, privacy practices, smart contracts, and risks before using the service.

8.2 External Wallets

Wallet providers are independent services.

EAPES does not control wallet software, private keys, recovery phrases, security settings, or wallet-provider terms.

8.3 External Marketplaces and Explorers

Marketplace and blockchain-explorer services are independently operated.

Listings, prices, offers, liquidity, availability, and external content are not controlled or guaranteed by EAPES.

8.4 External Social, Media, and Community Services

Discord, X, Telegram, Instagram, YouTube, Medium, and other external platforms apply their own terms and privacy practices.

9. Historical Archives

The materials below relate to discontinued EAPES programs or previous versions of legal documents.

Archived materials are provided only for:

  • transparency;
  • historical consultation;
  • record-keeping; or
  • recovery of legacy assets where expressly available.

An archived page is not an active Service.

Archived Services do not accept:

  • new deposits;
  • new stakes;
  • new pool positions;
  • new swaps;
  • new governance proposals;
  • new votes; or
  • new participation.

An archived page must not automatically connect a wallet or prepare a transaction, except for a clearly identified and necessary exit-only recovery function.

9.1 Historical Governance Archive

Status: Archived — Read Only

This archive preserves records of a discontinued EAPES governance platform.

EAPES does not currently operate:

  • a DAO;
  • a holder-governance program;
  • a voting system;
  • a proposal or quorum system;
  • a DAO treasury; or
  • a collective treasury owned by holders.

This archive does not provide current voting, management, ownership, treasury, revenue-sharing, royalty, or economic rights.

9.2 Island Relics Staking

Status: Archived — Closed

The former Island Relics NFT staking program is closed and no longer accepts new deposits.

Historical participation information may remain available for record-keeping.

Where a legacy asset-recovery function remains necessary, it must be clearly identified as Legacy Withdrawal, Recover Legacy Assets, or Exit Only.

9.3 Former EAPES-Operated $EAPES Pools

Status: Archived — Closed

The former EAPES-operated $EAPES Pool interfaces are closed.

EAPES does not currently offer an internal $EAPES staking or liquidity pool.

Independent third-party services, if any, operate under their own terms and risks.

9.4 Banana Swap

Status: Archived — Closed

The former EAPES Banana conversion service is closed.

EAPES does not provide a Banana or Banana Point conversion service into $EAPES.

The historical 5:1 conversion ratio is not an active EAPES feature.

This document is preserved for historical reference. It has been replaced and is not the current version governing new use of the Services. It may continue to apply to an earlier transaction or right according to its original scope. The current version is available in the EAPES Legal Centre.

Historical legal documents must not be silently rewritten. Corrections or annotations should be clearly identified without altering the original archived text.

11. Order of Priority

Unless a document expressly states otherwise, the following order applies to a specific product or transaction:

1. a signed individual agreement;

2. product-specific terms accepted for the transaction;

3. the current EAPES Terms of Use;

4. an incorporated policy or program rule;

5. general informational content.

An archived document does not govern new use unless it expressly remains applicable to an earlier transaction or right.

12. Regulatory Availability

EAPES products and Services are made available only where permitted under applicable law.

Availability may vary by jurisdiction, and EAPES may restrict or refuse access where legal, regulatory, eligibility, sanctions, security, or technical requirements apply.

Nothing in the Legal Centre represents regulatory approval, registration, authorization, classification, or endorsement of $EAPES, an NFT, a virtual plot, or another EAPES product.

13. Language

Legal documents should be available in English and French where required.

Where applicable law requires the French version of a standard-form or adhesion contract to be provided before a user chooses another language, the French version will be presented first.

The selected language, document version, acceptance date, and acceptance method may be recorded.

Current legal documents should be:

  • readable on desktop and mobile;
  • available without requiring wallet connection;
  • printable or downloadable;
  • versioned;
  • accessible through persistent footer links; and
  • presented in clear language.

A user should be able to access the version accepted for a prior transaction where reasonably available.

15. Corporate and Intellectual Property Notice

EAPES, a company registered in Québec, Canada, operates EAPES.COM and APP.EAPES.COM from its business and mailing address at 1055 Rue Lucien-L'Allier, Unit #886, Montreal, QC H3G 3C4, Canada, subject to the applicable terms.

Unless expressly identified otherwise:

EAPES L.L.C. owns the EAPES intellectual property.

Operation of a particular website, application, product, validator, or Service may be performed by another EAPES entity identified in the applicable terms.
