1. Commitment to Intellectual Property

EAPES is committed to respecting intellectual property in all its forms, including copyrights, trademarks, and other similar rights. We require our users and community to uphold the same rigorous respect for these rights.

2. User-Generated Content (UGC)

If EAPES permits the publication of user-generated content (UGC), each contributor assumes full responsibility for the content they submit. Any violation of copyright, trademark, or intellectual property rights is strictly prohibited.

Important Note: As of today, EAPES services do not allow the publication of UGC. This section will be updated if this policy changes.

3. Reporting an Infringement (DMCA Takedown Request and Notice of Violation)

If you are a copyright holder or an authorized representative and believe that content accessible through our services infringes your rights, you may submit a formal infringement report.

To be considered valid, your report must include:

  • A precise description of the copyrighted work you believe has been infringed.
  • The URL or exact location of the allegedly infringing content.
  • Your complete contact information: name, mailing address, email, and telephone number.
  • A statement affirming that you believe in good faith that the use of the content is not authorized by the rights holder, their agent, or the law.
  • A declaration, under penalty of perjury, that the information provided is accurate and that you are authorized to act on behalf of the rights holder.
  • Your signature (handwritten or electronic).

Legal Compliance: EAPES complies with the United States’ Digital Millennium Copyright Act (DMCA) as well as Canada’s "notice and notice" regime. Depending on the applicable jurisdiction, we may forward notices of violation to the users concerned.

4. Processing of Requests

Upon receipt of a valid report, EAPES commits to:

  • Reviewing the request within an indicative period of 10 business days.
  • Forwarding a notice of violation to the concerned user, if required under Canada’s "notice and notice" regime.
  • Removing or disabling access to the allegedly infringing content, in accordance with applicable laws (e.g., DMCA for cases under U.S. jurisdiction).
  • Informing the user who submitted the content, where applicable.

In cases of repeated violations, EAPES reserves the right to restrict or terminate the offending user’s access to its services.

5. Counter-Notification Process

If you believe your content was removed or disabled in error, you may submit a counter-notification including:

  • Your complete contact information (name, address, email, telephone).
  • A description of the removed content and its original location.
  • A statement, under penalty of perjury, affirming that the removal or disabling resulted from a mistake or misidentification.
  • Your consent to the jurisdiction of the competent courts.
  • Your signature (handwritten or electronic).

How to Submit a Counter-Notification:

EAPES will review counter-notifications within an indicative period of 10 business days and may restore the content if the conditions are met.

6. Abusive Claims

Any false statement or abusive use of the reporting process is strictly prohibited. EAPES reserves the right to take action against abuse, including account suspension or legal proceedings if necessary.
